Schumer, Young Introduce AI LEAD Act to Hold Developers Accountable

Two U.S. senators, Chuck Schumer (D-NY) and Todd Young (R-IN), have introduced the AI LEAD Act on September 27, 2023. This bill aims to hold AI system developers accountable for harm caused by their products, following recent tragedies involving AI chatbots. The AI LEAD Act creates a path for civil lawsuits against AI developers by the U.S. attorney general, state attorneys general, individuals, or a class of individuals. It also makes AI deployers potentially liable if they modify an AI system substantially or intentionally misuse it. The legislation is endorsed by various organizations, including the American Association for Justice, Fairplay for Kids, Social Media Victims Law Center, and Tech Justice Law Project. These endorsements reflect the growing concern over AI safety, especially after at least two teen suicides following interactions with AI chatbots. The AI LEAD Act aims to incentivize safety in the growing AI technology by enabling lawsuits when systems cause harm. The AI LEAD Act, introduced by Sens. Schumer and Young, seeks to establish federal legal grounds for product liability claims against AI systems. It aims to protect users and promote responsible AI development, following recent tragedies and endorsements from various organizations.
