Federal Government Bolsters Justice System with €1 Billion Investment

The federal government is taking significant steps to combat tax evasion and fraud by strengthening the justice system. This move is part of the renewed 'Pact for the Rule of Law' between the Federal Government and the German states, which aims to bolster justice personnel and promote digitalization in the judiciary.

The pact, which reflects the coalition agreement's commitment to resource strengthening and digital transformation in justice, has secured around €1 billion in federal funds. These funds will be distributed to the states in two tranches, presumably in 2026 and 2028.

The funds will primarily be allocated to three key areas:

  1. Strengthening justice personnel to address long proceedings and the shortage of judicial staff.
  2. Accelerating digitalization in the judiciary to modernize court processes and administrative tasks.
  3. The total federal funding distributed to the states under this pact is framed in the multibillion-euro range, with an explicit focus on both enhancing human resources and implementing digital solutions to improve the rule of law.

The Ministry of Justice also plans various legislative projects to speed up procedures in justice. Federal Minister of Justice Stefanie Hubig described the €450 million in federal funds as a "clear signal for the rule of law and democracy in our country, given the tight budget situation."

The black-red coalition has emphasized the importance of a well-equipped, capable rule of law. Federal Minister of Finance Lars Klingbeil (SPD) views the investment as an "investment in more justice in our country."

However, there is an urgent need to bring the judicial system up to date. Around 2,000 public prosecutors and criminal judges are missing nationwide, leading to longer criminal proceedings and overburdened investigators dropping cases.

The federal government's support for justice reforms amounts to €450 million in total. In addition, the government is providing a total of €240 million euros for the personnel strengthening of justice alone in the current legislative period.

The initial funding for the pact was €220 million, provided by the then federal government under Chancellor Angela Merkel (CDU). The renewed pact, which doubles its support, has been welcomed by judges' and lawyers' associations.

Sven Rebehn, federal managing director of the German Judges' Association (DRB), calls for the states to fulfill their commitments for new positions in justice. Swen Walentowski, deputy managing director of the German Bar Association (DAV), supports the federal government's plans to modernize justice.

The new pact also emphasizes the importance of maintaining legal protection while improving efficiency. Video hearings should be possible at all courts, but efficiency gains should not come at the expense of legal protection.

This renewed cooperation between the federal government and the states epitomizes a strengthened commitment to upholding the rule of law across German states. The funds will not only improve the equipment of justice and police but also increase staff to address the current shortage and speed up procedures.
